Yonaton Aronoff, Evan Bolla Win Dismissal of Multimillion-Dollar Claims Against HSW Client

Harris St. Laurent & Wechsler LLP partners Yonaton Aronoff and Evan Bolla have won the dismissal of multimillion-dollar tortious interference and aiding and abetting breach of fiduciary duty claims against their client, a venture capital firm that served as an investment banker.

The plaintiff, the former CEO of a major food and beverage distributor, claimed that one of the institution’s employees made misleading and defamatory statements that prompted his ouster from that entity. He claimed that this, in turn, caused the company to lose $25 million in investment commitments and ultimately collapse.

In support of their client’s dismissal motion brought in the Commercial Division of the New York Supreme Court, Yonaton and Evan developed several novel legal arguments attacking the causation element of the CEO’s claims. After a lengthy oral argument, the Commercial Division was persuaded to dismiss the CEO’s amended complaint in its entirety.
