Law360 recently highlighted Harris St. Laurent & Wechsler's work on behalf of Congolese mining company Katanga Contracting Services SAS to enforce Katanga's $16.7 million arbitration award against Tenke Fungurume Mining SA, a metals producer in the Democratic Republic of the Congo (DRC). The U.K.'s International Chamber of Commerce tribunal granted the award on August 26, 2021 following arbitration proceedings tied to various commercial contract disputes.
On behalf of Katanga, Harris St. Laurent & Wechsler has moved to compel Bank of America to disclose all assets Tenke currently holds with the bank in New York. The firm took this step as part of Katanga's ongoing efforts to locate and freeze Tenke's international assets in response to Tenke's alleged default on paying the full arbitral award. In its filing, Katanga claims Tenke is actively moving its global assets back into the DRC to hamper Katanga’s arbitral award enforcement efforts.
