Partner Reid Skibell published a recent article in the New York Law Journal addressing the uncertainty about whether and how restrictive covenants can bind lawyers in law firm breakups. “The law varies from state to state, but most have adopted one of two diametrically-opposed approaches,” writes Skibell. “This divergence creates difficulties for firms with offices in multiple states, as there is no straightforward way to evaluate the risks and benefits of adopting and enforcing restrictive covenants.” Skibell regularly counsels companies, executives and professionals in disputes related to discrimination, employment and separation agreements, compensation, and breaches of non-compete agreements.
